Criminal law
Attorney Indrek Kukk has specialised in criminal law and a significant part of his work at the law office involves criminal law and misdemeanour law in particular. As members of the Estonian Bar Association, we are competent to appear before all authorities and courts, including the Supreme Court and the European Court of Human Rights.
We deal with the disputes of all of the main types of crime: economic crimes, professional crimes, drug crimes, traffic offences, crimes against intellectual property, environmental crimes, offences against persons, and crimes against property.
In the field of criminal offences, we are experienced in the adjudication of matters dealing with traffic offences, offences related to environmental law (waste management, hunting, fishing, etc.), and offences against public order. We have dealt with a large number of proceedings brought by the Tallinn Municipal Police Department. Suspects and accused persons have the right to a lawyer during the pre-trial investigation and in court. It is often wise to reach an agreement with the prosecutor if the facts of the case point to a clear conviction. In such situations, we can assist you in reaching the most favourable settlement possible.
We have experience in criminal proceedings where the following issues arise: arrest, substitution of arrest with electronic monitoring or bail, seizure and confiscation of property, mandating the enforcement of imprisonment, early release from prison, and surveillance operations.
We consult on ongoing issues and help during an interview or examination. We prepare the necessary procedural documents, e.g. a criminal complaint, a complaint against the actions of the police or prosecution, a statement of defence, an appeal, a cassation, an appeal against a decision, a petition for a review, an application to the European Court of Human Rights. If damage is caused in criminal proceedings (e.g. by wrongful arrest), we help to recover those damages from the state.
